1 Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SMM Spot ("Company," "we," "our," or "us") governing your access to and use of the SMM Spot website and services.

By accessing or using our services, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

SMM Spot provides social media marketing services including, but not limited to, followers, likes, views, comments, shares, and other engagement metrics for various social media platforms.

We reserve the right to:

• Modify, suspend, or discontinue any service at any time without prior notice
• Refuse service to anyone for any reason at our discretion
• Change pricing at any time, with existing orders honoured at the price quoted at time of purchase
• Set limits on orders, quantities, or usage per account

Services are provided for entertainment, social proof, and marketing purposes. Results may vary depending on platform algorithms and account-specific factors.

3 Your Account

To place orders, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Providing accurate and up-to-date account information
• Notifying us immediately of any unauthorized use of your account

We are not liable for any loss or damage arising from your failure to protect your account credentials. You may not share, sell, or transfer your account to another party.

We never ask for your social media passwords. Any representative claiming to need your password is not acting on behalf of SMM Spot.

4 Payments & Refunds

Payments: All payments are processed securely. We accept major credit/debit cards, PayPal, and cryptocurrency. Prices are listed in USD unless otherwise stated. You are responsible for applicable taxes.

Refunds: Refunds may be issued in the following circumstances:

• Order was not delivered within the specified timeframe
• Order was placed for a private or non-existent account
• Technical errors on our part that prevent fulfilment

Refunds are not issued for:

• Orders already completed or partially delivered
• Account bans or suspensions by social media platforms
• Natural drop in metrics after delivery (use our refill guarantee)
• Change of mind after order placement

Refund requests must be submitted within 7 days of the order date via our contact page.

5 Prohibited Conduct

You agree not to use our services to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Engage in fraudulent activity or place orders with stolen payment methods
• Attempt to reverse-engineer, hack, or disrupt our platform
• Abuse our refund or refill policies
• Resell services without our express written permission (Reseller API required)
• Use automated bots to interact with our website beyond normal service use
• Order services for accounts you do not own or have permission to manage

Violation of these rules may result in immediate account suspension and forfeiture of account balance.

6 Delivery & Results

We strive to deliver all orders within the estimated timeframes displayed on each service. Delivery times are estimates and may vary due to:

• High order volume or platform maintenance
• The target account being private, suspended, or deleted
• Platform algorithm changes or rate limiting

We offer a Refill Guarantee — if your metrics drop within 30 days of delivery, we will refill them at no charge. Refill requests can be submitted via your account dashboard.

Results are not guaranteed to be permanent, as social media platforms may remove accounts or content as part of their own enforcement actions.

7 Intellectual Property

All content on the SMM Spot website — including text, graphics, logos, icons, images, and software — is owned by or licensed to SMM Spot and protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission. You may share links to our website for legitimate purposes.

8 Disclaimers

Our services are provided on an "as is" and "as available" basis without any warranties, express or implied. We do not warrant that:

• Services will be error-free or uninterrupted
• Results will meet your specific expectations
• Delivered engagement will be retained permanently

SMM Spot is an independent service provider and is not affiliated with, endorsed by, or sponsored by any social media platform including Meta, TikTok, Google, or Telegram.

9 Limitation of Liability

To the fullest extent permitted by law, SMM Spot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

• Your use of or inability to use our services
• Social media platform actions taken against your account
• Unauthorized access to or alteration of your data
• Any other matter relating to our services

Our total liability for any claim shall not exceed the amount paid by you to SMM Spot in the 30 days preceding the event giving rise to the claim.

10 Termination

We may suspend or terminate your account at any time, with or without notice, for any reason including violation of these Terms. Upon termination:

• Your right to access our services ceases immediately
• Pending orders may be cancelled at our discretion
• Account balance may be forfeited if termination was due to Terms violation

You may close your account at any time by contacting our support team. Closing your account does not entitle you to a refund of any balance unless otherwise required by law.

11 Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration rather than court proceedings, except where prohibited by law.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
